  • Content Operations management
  • Analytics & Strategy consulting

Specific services and deliverables are defined in individual service agreements or statements of work between AURIUM and the client.

3. User Obligations

When using our services, you agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of any account credentials
  • Use our services only for lawful purposes
  • Not interfere with or disrupt our services
  • Not attempt to gain unauthorized access to our systems
  • Comply with all applicable laws and regulations

4. Intellectual Property

All content, materials, trademarks, logos, and intellectual property on this website and in our services are owned by AURIUM COMPANY LLC or licensed to us. You may not use, reproduce, or distribute any such content without our express written permission.

Work product created specifically for clients under service agreements will be governed by the terms of those individual agreements.

5. Payment Terms

Payment terms, pricing, and billing cycles are specified in individual service agreements. General terms include:

  • Invoices are due within the timeframe specified in the agreement
  • Late payments may result in service suspension
  • All fees are non-refundable unless otherwise specified
  • Clients are responsible for any applicable taxes

6. Service Level and Performance

While we strive to deliver exceptional results, marketing and growth outcomes depend on numerous factors beyond our control. We do not guarantee specific results such as revenue increases, follower growth, or conversion rates unless explicitly stated in writing in a service agreement.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the business relationship. This includes but is not limited to business strategies, financial information, and technical processes.

8. Term and Termination

These Terms remain in effect while you use our website and services. Either party may terminate service agreements according to the terms specified in individual contracts. Upon termination:

  • All outstanding fees become immediately due
  • Access to AURIUM systems and tools will be revoked
  • Confidentiality obligations continue to apply
  • Each party will return or destroy confidential information

9. Limitation of Liability

To the maximum extent permitted by law, AURIUM COMPANY LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from:

  • Use or inability to use our services
  • Errors or omissions in our services
  • Unauthorized access to your data
  • Third-party services or platforms we integrate with

Our total liability for any claims arising from our services shall not exceed the fees paid by the client to AURIUM in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AURIUM COMPANY LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

11. Third-Party Services

Our services may integrate with or rely on third-party platforms and tools (e.g., Meta Ads, Google Ads, CRM systems). We are not responsible for the availability, performance, or policies of these third-party services.

12. Modifications to Terms

AURIUM reserves the right to modify these Terms of Service at any time. We will notify users of material changes via email or website notice. Continued use of our services after changes constitutes acceptance of the modified terms.

13. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation, if negotiation fails
  • Binding arbitration in accordance with commercial arbitration rules

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of New Mexico.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with any individual service agreements and our Privacy Policy, constitute the entire agreement between you and AURIUM COMPANY LLC regarding the use of our services.
